2.3. The Website is offered to you conditional upon your acceptance of these terms and conditions along with any notices contained in these terms and conditions and the Website itself. Continuing to use this website, shall deem acceptance to these Terms and Conditions.

2.4. We reserve the right to revise our terms and conditions along with any other policies and procedures at any time, with any such revision immediately made effective and binding once posted to this website.

2.5. You must be at least 18 years of age to use this website. By using the website and agreeing to these terms and conditions, you warrant that you are at least 18 years of age.

2.6. You may not transfer any of your rights under these terms and conditions to any other person without our acceptance. We may transfer our rights under these terms and conditions where we reasonably believe your rights will not be affected.

3. Applicable Law

3.1. This website and our services are governed by law of England and Wales.

3.2. Any and all claims, disputes, or other legal proceedings by or between you or us, including but not limited to any such claims or disputes that are in any way related to or arising under these Terms shall be governed by and interpreted in accordance with the laws of England and Wales.

3.3. All dispute must be settled within the United Kingdom. in the event of a disagreement that can not be resolved by the terms within these terms and conditions, the matter shall be resolved via arbitration, using an arbitrator of our choice from the Charted institute of Arbitrators. Unless Sell My Home Now consider another form of dispute resolution more appropriate.

5. Intellectual property and Conditions of use

7. Property buying service terms of use

7.1 Offer in Principle
7.1.1. Upon receipt of an enquiry from yourself Sell My Home Now will consider if we would like to make you an offer to purchase your property or not.

7.1.2 If we want to make you an offer to purchase your property Sell My Home Now will assess your property and calculate what we would be prepared to pay for your property and will make an offer in principle (“Offer in Principle”).

7.1.3. The Offer in Principle is what Sell My Home Now is prepared to pay for the property, based on the information provided by you. After receiving the Offer in Principle If you would like to proceed with the sale, you will be asked to accept the Offer in Principle by signing and returning a copy of the agreement to us.

7.1.4. Upon receipt of the signed acceptance of the Offer in Principle we will then arrange for an appraisal of the property, a valuation will be undertaken via one of the following methods:

A. Property management company
B. Estate agent
C. RICS valuer
D. Desktop valuation
E. Other Method

7.1.5. Upon receipt of the appraisal report we will make a formal offer to you (the “Formal Offer”). The Formal Offer is not a valuation of the property but the price we are prepared to pay for the property.

7.2. Formal Offer
Our Formal Offer will be subject to the following conditions:
A. A survey and/or valuation acceptable to the Buyer (Sell My Home Now)
B. Receipt of satisfactory evidence of your title to the property.
C. Satisfactory replies to searches on the property including but not limited to the following: local authority, mining, drainage, any other relevant searches against the Property.
D. A mortgage and/or offer of loan on the Property on terms acceptable to the Buyer.
E. Your property is as described during the initial valuation.

7.3 Formal contract
7.3.1. Once the acceptance of our formal offer has been received, we will then need to confirm your identity. This will be done in accordance with our Anti Money Laundering Policy, no transaction can be completed without confirming your identity.

7.3.2. Upon completion of the steps referred to in clause 7.2 above we will either reconfirm our Offer to yourself or submit an alternative offer to reflect any adverse matters identified. We will on request provide you or your solicitor with a copy of the legal report and the RICS survey report we receive.

7.4 Charges

Our property buying service is free of charge, all costs incurred by Sell My Home Now in relation to purchasing your property will be paid by Sell My Home Now.

7.5 Independent Legal Advice

7.5.1. You must take Independent Legal Advice when selling your property to Sell My Home Now. You can either instruct a solicitor of your choice, or alternatively we can recommend one to act on your behalf.

7.5.2. If you wish us to recommend a solicitor to you, we will expressly ask you to confirm that when signing to accept the Offer in Principle.

7.5.3. Subject to completion of the transaction we will, if you use a solicitor recommended by us, pay all the legal fees incurred in connection with the transaction. If you instruct a solicitor not recommended by us, we will on completion contribute £550 for your legal fees.
Please be aware that if you choose a solicitor who has not been recommended by us, we will subsequently have to undertake due diligence checks on your legal representative in accordance with our Anti Money Laundering Policy.

7.6 Right to cancel

You have the right to cancel this contract within 14 days without giving a reason in accordance with the Consumer Contracts Regulations 2013. To exercise your right to cancel you (the Seller) must inform the Buyer (Sell My Home Now) of your decision to cancel this contract by sending us a clear statement confirming that you would like to cancel this contract. You can send this confirmation by emailing us at admin@carlh67.sg-host.com or by post to Sell My Home Now Limited, International House, 61 Mosley Street, Manchester, M2.

7.7 Effects of Cancellation

If you cancel this agreement, you will be released from all obligations under it, we will not seek to recover costs from you.

7.8. Other important terms

7.8.1. When Sell My Home Now purchase your property you (the Seller) will be required to provide Sell My Home Now with the following:

A. To pass all risk on completion. (title and risk will only be passed to Sell My Home Now after the legal transfer has been completed).
B. To give vacant possession on completion
C. A full title guarantee

7.8.2. We may require you to transfer the Property on completion to an associated company or to a third party or a sub-purchaser from us.

7.8.3. If the Buyer (Sell My Home Now) requires the Seller to transfer the Property to a another party, the Buyer will inform you (the Seller) through the documentation provided to the Sellers solicitor advise the Seller of the price to be paid by the third party to the Buyer.

7.8.4. The Offer Price to the Seller may change dependent on the price agreed with the third party. The Seller acknowledges that the difference in the price to be paid by the third party and the Offer Price or any amended Offer Price will be retained by the Buyer.

7.8.5. We reserve the right to transfer this agreement to someone else. We may transfer our rights and obligations under these terms to another organization or person.

7.8.6. By accepting our offer in principle, you automatically grant us permission prior to completion to market your property, this includes but not limited to the following:
A. Upload your property to a Property Portal website
B. property can be marketed for sale by an Estate Agency of our choice

7.8.7. You are not removed from your obligations under this agreement If we delay in enforcing any part of this contract, we can still enforce it later.

7.8.8. We will with reasonable endeavours try to meet your desired completion date, however we accept no liability if a completion date cannot be met or if a purchase does not take place for whatever reason.

7.9 Force Majeure

7.9.1. If we are prevented, delayed or hindered from undertaking any of our obligations in relation to this contract due to a Force Majeure Event, our obligations under these terms and conditions will be suspended while the Force Majeure event continues to delay, hinder or prevent us undertaking any of our obligations.

7.9.2. as soon as reasonably practicable up on the commencement of a Force Majeure Event, we will notify you in writing of the Force Majeure Event, the notice will inform you when the Force Majeure event started and the effects of the Force Majeure Event on our ability to perform our obligations under these terms and conditions.

7.9.3. If a Force Majeure Event continues to impact our ability to perform our obligations under these terms and conditions for a period of more than four (4) months in total, either party may terminate the agreement by giving notice in writing to the other party.

7.10 How we may use your personal information

Sell My Home Now will only use your personal information in line with our policies including but not limited to the following:
A. Privacy Policy
B. Cookie Policy
C. Anti Money Laundering Policy

7.11 Confidentiality

Any information you obtain with regards to Sell My Home Now shall be considered as confidential. You must not divulge information to any person (except to your advisors) without our prior written consent. This condition shall not extend to information which was rightfully in your possession prior to requesting an offer of purchase or which is already considered to be public knowledge.

8. Limitation of Liability

8.1. Nothing in these terms and conditions will: (a) limit or exclude our or your liability for death or personal injury resulting from our or your negligence, as applicable; (b) limit or exclude our or your liability for fraud or fraudulent misrepresentation; or (c) limit or exclude any or our or your liabilities in any way that Is not permitted under applicable law.

8.2. We will not be liable to you in respect of any losses arising out of events beyond our reasonable control.

8.3. To the maximum extent permitted by law, accepts no liability for any of the following:
a. Any business losses, such as loss of profits, income, revenue, anticipated savings, business, contracts, goodwill or commercial opportunities.
b. Loss or corruption of any data, database, hardware or software;
c. Any direct, indirect, special, incidental or consequential loss or damages

8.4. We accept no liability for the content of this website.

8.5. If Sell My Home Now is found to be liable for any action other than those stated in clause 8.1. Our total liability is limited to the sum of £10.
